Where the Participant is under 18 years of age

Where Participant is under 18 years of age I, being a parent or legal guardian of the person named in this acknowledgement and release hereby acknowledge and agree:

  • I have read the whole document and understand it.
  • I consent to the person, named in this acknowledgement and release, participating in the activity, and
  • I am aware of the risks, dangers and obligations set out above in this acknowledgement and release.

In consideration of the person named in this Acknowledgement and Release being accepted to participate in any activity I agree to release and indemnify Newcastle MMA as the operator, its servants and agents, in the same manner and to the same effect and extent as if I were the person first named in this Acknowledgement and Release and the person participating in any of the activities.

Membership terms and conditions

While training at Newcastle MMA I acknowledge the following:

STOPPING OR CANCELLING OF FEES:

  • 4 WEEKLY MEMBERSHIP FEES CAN NOT BE STOPPED
  • 12 WEEKLY MEMBERSHIP FEES CAN BE STOPPED FOR 1 WEEK
  • 24 WEEKLY MEMBERSHIP FEES CAN BE STOPPED FOR 2 WEEKS
  • 52 WEEKLY MEMBERSHIP FEES CAN BE STOPPED FOR 4 WEEKS
  • DIRECT DEBIT CANCELATION FEE AS PER DEBIT AGREEMENT OR CURRENT RATE
  • DIRECT DEBIT SUSPENSION FEE AS PER DEBIT AGREEMENT OR CURRENT RATE
  • DIRECT DEBIT RESTART FEE AS PER DEBIT AGREEMENT OR CURRENT RATE
  • ALL STOPPAGES AND CANCELLATIONS MUST BE COMMMUNICATED IN WRITING / EMAIL (JL@NEWCASTLEMMA.COM.AU) PRIOR TO THE DESIRED CANCELLATION DATE OF ANY OF THE MEMBERSHIP PURCHASED
  • ALL FEES AND PRICES ARE SUBJECT TO CHANGE! CONDITIONS APPLY!

IT IS IMPORTANT TO NEWCASTLE MMA ACADEMY THAT ALL CLIENTS AND STUDENTS UNDERSTAND THEIR RIGHTS AND OBLIGATIONS IN RELATION TO REFUNDS.

NEWCASTLE MMA ACADEMY REGISTRATION & MEMBERSHIP IS A NON-REFUNDABLE FEE, IN REGARDS BUT NOT LIMITED TO, IF YOU DON’T USE UP YOUR MEMBERSHIP, CHANGE YOUR MIND DURING PAID MEMBERSHIP TERM, OR DECIDE TO KEEP PAYING WHILE NOT ATTENDING THE CLASSES AND FACILITY.

SHOULD YOU BELIEVE THAT YOUR CIRCUMSTANCES FOR A REFUND REQUIRES SPECIAL CONSIDERATION, PLEASE MAKE AN APPLICATION IN WRITING TO THE MANAGER VIA EMAIL TO JL@NEWCASTLE.COM.AU SHOULD A REFUND BE APPROVED YOU WILL BE NOTIFIED BY RETURN EMAIL WITHIN 10 WORKING DAYS AND ASKED TO RETURN YOUR TAG TO THE FOLLOWING ADDRESS BEFORE THE REFUND WILL BE PROCESSED:

  • WE DO NOT REFUND MEMBERSHIPS IF THE MEMBER FAILS TO INFORM NEWCASTLE MMA IN WRITING OF THEIR WISH TO CANCEL THEIR MEMBERSHIP
  • ANY INAPROPRIATE USE OF THE FASCILITIES AND THE RESPECTIVE MEMBERSHIPS PURCHASED WILL RESULT IN AN INITIALL PENALTY FEE OF 300.- AND IN SEVERE CASES A POSSIBLE EXCLUSION FROM THE CLUB
  • THERE IS AN ADDITIONAL PROCESSING FEE BY DEBIT SUCCESS FOR DIRECT DEBIT BOUNCE BACKS IF THERE IS NOT ENOUGH MONEY IN ONES ACCOUNT OR ACCOUNT / CC DETAILS HAVE BEEN CHANGED
  • NEWCASTLE MMA RESERVES THE RIGHT TO ADD CONDITIONS IN THE FUTURE. FUTURE CONDITIONS MAY NOT BE LISTED HERE. PLEASE ASK STAFF FOR DETAILS.
  • YOUR ORIGINAL NEWCASTLE MMA REGISTRATION / MEMBERSHIP TAG MUST BE RETURNED IF YOU CANCEL YOUR MEMBERSHIP WITH NEWCASTLE MMA. IF THE MEMBERSHIP TAG IS NOT RETURNED, AN ADDITIONAL 45$ CHARGE WILL OCCUR DURING CANCELLATION, WHICH IS SEPERATE FROM THE CANCELLATION FEE.

Acknowledgment Release and Assumption of Risk. This is an important document, which affects your legal rights & obligations. Please read it carefully and do not sign it unless you understand it. If you have any questions please ask!

Acknowledgment of Risks, Injury and Obligations
I acknowledge that the activities and Martial Arts I am about to undertake have potential dangers and by participating in them I am exposed to certain risks including death.
I acknowledge and understand that whilst participating in any such activities and Martial Arts:

  • I may be injured, physically or mentally, or may die.
  • Any physical condition I may have, of which I may or may not be aware, of which I may or may not have disclosed to the centre or its staff, may be aggravated or worsened by my participation.
  • My personal property may be lost or damaged.
  • Other persons participating in such activities may cause me injury or may damage my property.
  • I may cause injury to other persons or damage their property.
  • The conditions in which activities are conducted may vary without warning.
  • I may be injured or die or suffer damage to my property as a result of the negligence or breach of contract of the fitness centre operator, its servants or agents.
  • There may be no or inadequate facilities for treatment or transport of me if I am injured. I assume the risk of, and the responsibility for any injury, illness, death, loss or damage of property resulting from my participation in any activities and Martial Arts. Release and Indemnity to NEWCASTLE MMA Operators In consideration of the acceptance of my payment (or guest status) for participating in any activity (and except to the extent that the centre may be precluded by statute) I agree to release & indemnify NEWCASTLE MMA as the operator & their staff as follows:
  • I participate in the activities at my sole risk and responsibility.
  • I release, indemnify and hold harmless the Gym operator, its servants and agents, from and against all and any actions or claims which may be made by me or on my behalf or by other parties for or in respect of arising out of any injury, loss, damage or death caused to me or my property whether by negligence, breach of contract or in any way whatsoever. I also agree that in the event that I am injured or my property is lost or damaged, I will bring no claim, legal or otherwise, against NEWCASTLE MMA as the operator or its servants and agents, in respect of that injury, loss or damage.
